Lawyers contact government employers all the time for information regarding permits, appeals, applications, etc. But what about when litigation is pending or likely? What are your ethical obligations when it comes to contact with government employees that may be adverse (and represented) parties? We will discuss the applicable RPCs, plus proposed changes. The second half of the program will feature real-world application of these rules in the context of the Washington AGO’s pending lawsuits against various aspects of the new administration, including the travel ban and lawsuits against EPA and the Department of Interior.
