Navigating the U.S./China Trade War into the Biden Administration

Over the last four years, tensions between the United States and China escalated rapidly with the battle squarely focused on trade between the two countries. With strong bipartisan support, many of the recent U.S. efforts to sanction Chinese companies are expected to continue – and perhaps grow – during the Biden Administration, but the focus shifts from imbalance in the trade toward more on competition in technology. U.S. and Chinese industry have worked together for decades to advance technology in both countries but U.S. industry remains concerned with protection of intellectual property in working with Chinese partners.
In this panel session, a group of international business law experts will discuss a range of topics about the escalating competition between the two countries. The panel, which will include lawyers from the United States and China, will discuss U.S. export control, import/customs, and sanctions laws; CFIUS review of Chinese investment in the United States; data security and online privacy; and intellectual property protection. Legal experts from China will discuss how U.S. companies can navigate similar issues on the Chinese side. The panel will discuss how U.S. companies can navigate these issues contractually and will provide insight into how the ever-evolving U.S./China geopolitical relationship will impact those relationships in the coming years.
